Fred Lee was successful in obtaining appropriate medical treatment for his client, a truck driver catastrophically injured in a workers’ compensation accident. The indemnity component of the client’s case was resolved by settlement years ago, but medical liability remains open. The Administrative Law Judge found in favor of the client, ordering the employer to provide and pay for the treatment sought. Moreover, the Administrative Law Judge also included in his award an assessment of attorneys’ fees and expenses against the employer. The employer conceded the substantive issue regarding the medical treatment, but appealed the assessed fees and expenses to the Appellate Division of the State Board. The Appellate Division affirmed the award.
